Ask&Fix Ltd does not actively supervise, direct, or control the actions of Experts. We do not guarantee their background, qualifications, identity, or the reliability of the responses they provide. In certain cases, an Expert may receive a “Verified” status, which indicates that the individual has submitted documentation relevant to the subject area in which they respond. However, such verification is limited to the review of supplied documents and does not imply endorsement or confirmation of expertise by Ask&Fix Ltd.

Experts are solely responsible for the content they provide, and for determining which inquiries to respond to and how. Their guidance may include general suggestions or informational summaries, but the Experts do not perform physical tasks, technical interventions, or in-person consultations of any kind.

Ask&Fix Ltd makes no assurances that a particular question will receive a response or that the answer provided will meet the Client’s expectations. We shall not be held liable for any content created by Experts, nor for any outcomes, damages, or disputes resulting from interactions between Users.

1.3. Reliance on User-Generated Content

Users acknowledge that all communications, responses, and information submitted through the platform — including questions, answers, comments, profiles, or recommendations — constitute “Content” and are generated independently by Users. Ask&Fix Ltd does not create, edit, verify, or guarantee any such Content, whether posted by Experts or Clients.

All Users are responsible for the accuracy, legality, and integrity of the Content they contribute. We do not warrant that any information posted on the platform is complete, current, or reliable. Ask&Fix Ltd disclaims all responsibility for Content accuracy or outcomes resulting from reliance upon it.

Although we reserve the right to remove Content or suspend access for violations of these Terms, Ask&Fix Ltd is not obligated to review or monitor any User communications. Use of information from the platform is entirely at your own risk and discretion.

2. User Accounts

2.1. Eligibility Criteria

To access the full range of services provided by Ask&Fix Ltd, you must create a personal account on the Website. By registering, you confirm that you are at least 18 years of age or have reached the legal age of majority in your jurisdiction, whichever is higher. You must also possess the legal capacity to enter into a binding agreement with Ask&Fix Ltd under applicable laws.

2.3. Account Security and Responsibility

You are fully responsible for maintaining the confidentiality of your login credentials, including your password, and for all activity that occurs under your account. You agree not to share your login credentials with third parties or allow unauthorized individuals to access your account.

If you suspect any unauthorized use of your account or security breach, you must notify us immediately at support@asknfix.com.

You may not:

  • Create multiple or duplicate accounts unless explicitly approved by Ask&Fix Ltd.

  • Transfer, sell, lease, or sublicense your account to any other party.

  • Use another user’s account without their explicit consent and our prior approval.

Ask&Fix Ltd reserves the right to implement technological measures, including IP tracking or access restrictions, to prevent unauthorized use of the Website. In serious cases, we may contact your Internet Service Provider (ISP) to investigate misuse.

You agree to keep your contact and payment information accurate and up-to-date at all times. Failure to do so may result in disruption of service, billing errors, or account suspension.

3. User Declarations, Restrictions, and Conduct Policy

3.1. User Representations and Acknowledgements

By accessing and using the Ask&Fix platform, you confirm and represent that:

3.2. Prohibited Conduct

Account and Identity Misuse:

  • Creating or operating multiple accounts without permission;

  • Misrepresenting your identity or qualifications;

  • Impersonating another person or entity;

  • Accessing or using another user’s account without authorization.

Malicious or Abusive Behavior:

  • Engaging in harassment, abuse, stalking, or threats;

  • Uploading or distributing any form of harmful, obscene, or discriminatory content;

  • Promoting or inciting violence, hate speech, terrorism, or illegal activity.

Platform Abuse:

In the event of suspected or confirmed violations of this section, Ask&Fix Ltd reserves the right to:

  • Suspend or permanently deactivate user accounts without prior notice;

We may also restrict the number of messages or contacts a User can initiate within a 24-hour period to prevent spam or abuse.

4. Payments, Subscriptions, and Refund Policy

4.1. Subscription and Billing Terms

Ask&Fix Ltd offers Clients access to various platform features, including the ability to ask multiple questions, communicate with Experts, and receive informational responses via chat or messaging interfaces (“Platform Features”). These features are made available through a recurring subscription plan (“Subscription”).

Upon initial registration, new Clients may be offered a limited-time trial period for a symbolic, one-time fee (the “Trial Fee”). This Trial Fee may vary depending on promotional offers or geographic location but is commonly set at 1 USD. If you do not cancel during the trial period (as specified on the payment page), your account will automatically convert into a paid monthly Subscription.

The standard Subscription Fee is 29 USD, billed every 30 calendar days. Charges may vary depending on region, currency exchange rates, local taxes, or promotional pricing applicable to your account. The final price will always be displayed clearly on the payment page prior to your transaction.

By providing your payment information, you authorize Ask&Fix Ltd or its designated payment processor to charge the applicable fees using your selected payment method. You acknowledge and accept that your Subscription includes a recurring billing feature, and you are solely responsible for managing your Subscription, including any cancellation.

If your payment is split into separate transactions (e.g., partial charge followed by completion), you agree that both charges may occur on separate dates within the same billing cycle.

Ask&Fix Ltd is not responsible for any currency conversion charges, banking fees, or other third-party costs related to payment processing. Please consult your payment provider for details.

4.2. Fair Use and Account Restrictions

Subscriptions are offered for individual and non-commercial use only. Sharing your account, reselling access, or using the platform in any institutional, academic, or mass-querying context (including for plagiarism or academic dishonesty) is strictly prohibited.

To maintain the integrity of our service, Ask&Fix Ltd reserves the right to monitor usage patterns and may terminate or restrict access at its sole discretion if account activity appears excessive, automated, or fraudulent.

Furthermore, individuals who hold a Client Subscription — along with their close family members or household residents — may not act as Experts on the platform during the active term of the Subscription.

4.3. Refund Eligibility and Policy

Clients may request a refund within 30 calendar days from the date of their initial registration, provided that their usage of the Service was minimal or non-substantive. If approved, refunds may cover both the Trial Fee and the first Subscription Fee.

Refunds beyond the initial 30-day window, or for accounts that have actively engaged with the platform, are granted at the sole discretion of Ask&Fix Ltd. We reserve the right to deny any refund requests in cases of Terms violations, fraudulent behavior, or misuse of the platform.

Credits, promotional balances, or time-limited offers granted by Ask&Fix Ltd are non-refundable and remain the exclusive property of the Company. Unless otherwise stated, such credits will expire 30 days from issuance.

4.4. Cancellation of Subscription

You may cancel your Subscription at any time by:

  • Visiting your account dashboard and navigating to: My Account → Payment & Subscription → Cancel Subscription; or

  • Contacting our support team at support@asknfix.com.

Your access to the platform will remain active until the end of the current billing cycle, after which your Subscription will automatically terminate. You will not be billed further unless you re-subscribe.

Ask&Fix Ltd reserves the right to cancel your Subscription and/or restrict access to your account in the event of:

  • Failed or rejected payments;

  • Violations of these Terms;

  • Suspicious, abusive, or fraudulent activity.

Upon cancellation — by you or by us — you remain liable for any outstanding charges, including unpaid Subscription Fees and applicable taxes.

4.5. Marketing and Promotional Communications

By agreeing to these Terms, you consent to receive communications from Ask&Fix Ltd, including promotional emails, discount offers, and product updates, as outlined in our Privacy Policy. You may opt out of such communications at any time by updating your preferences within your account settings.

5. Communications and Customer Interaction Policy

By submitting your phone number, you confirm that:

  • You are the primary user or subscriber of that number;

  • You have the legal right to provide consent for communications;

  • You will notify Ask&Fix Ltd if your number changes or is no longer active.

We may also monitor or record calls for quality control, training, and dispute resolution purposes, in accordance with our Privacy Policy. All recorded data will be handled with appropriate security and confidentiality.

5.3. Appropriate Conduct When Contacting Customer Support

Ask&Fix Ltd is committed to maintaining a respectful and safe environment for both Users and support staff. When engaging with our customer service representatives — via chat, email, or other channels — you agree to communicate in a professional and courteous manner.

The following behavior is strictly prohibited:

7. Suspension or Termination of Account

7.1. General Provisions

You may terminate your account with Ask&Fix Ltd at any time by submitting a written request to support@asknfix.com. Upon confirmation, we will process the request and deactivate your account—typically within seven (7) business days. Once terminated, your access to Services and associated data will be discontinued.

Ask&Fix Ltd reserves the right to suspend, block, or permanently terminate any User account, cancel active subscriptions, or restrict access to any part of the Website or Services at any time and for any reason, including but not limited to:

  • Violation of these Terms,

  • Security concerns or suspected fraud,

  • Prolonged account inactivity (typically over 90 consecutive days),

  • Operational or technical reasons.

“Termination” means the permanent deletion of your profile and associated data from our systems.
“Suspension” or “Blocking” means the temporary or indefinite restriction of access to your account, subject to internal review.

All such decisions are made at the sole discretion of Ask&Fix Ltd and are not subject to appeal unless required by applicable law.

7.2. Termination Due to Death or Incapacity

In the event of a User’s death or legal incapacity, their legal representative or successor may contact Ask&Fix Ltd to request the closure of the associated account. Supporting documentation may be required, including legal verification of status and identity.

“Incapacity” refers to a certified physical or mental condition that renders the User unable to access or use the platform. A written statement from a licensed physician may be required, and Ask&Fix Ltd may, at its discretion, extend the service period at no additional cost rather than close the account immediately — particularly if the condition is expected to last less than six (6) months.

7.3. IP-Based Access Restrictions

Ask&Fix Ltd reserves the right to block access to the Website from specific IP addresses or geographic locations in order to:

  • Prevent unauthorized access or abuse,

  • Comply with international sanctions or regulatory requirements,

  • Business opportunities,

  • Data or information,

  • Device functionality or access,

  • Use of Services or software.

This limitation applies even if Ask&Fix Ltd has been advised of the possibility of such damages or losses.

Without limiting the foregoing, Ask&Fix Ltd shall not be liable for any losses or damages arising from or related to:

  • Your access to or inability to use the Website;

  • Reliance on any content or responses provided by Users or third parties;

  • Interactions with Experts, including their statements, recommendations, or omissions;

  • Unauthorized access to your account or data;

  • Interruptions, errors, system downtime, or loss of content or communication.

These limitations form a core basis of the agreement between you and Ask&Fix Ltd. Without such limitations, we would be unable to offer the Website or Services on commercially reasonable terms.

Maximum liability cap:
In any case, and under no theory of liability, shall Ask&Fix Ltd’s total liability to you exceed the greater of (a) the total amount you paid for Services in the 12 months preceding the incident giving rise to the claim, or (b) $100 USD.

11. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Ask&Fix Ltd, its affiliates, parent companies, subsidiaries, officers, directors, employees, agents, representatives, consultants, successors, and assigns from and against any and all claims, losses, liabilities, damages, judgments, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your use or misuse of the Website or Services;

  • Your breach of these Terms or applicable laws;

  • Any violation of third-party rights, including intellectual property, privacy, or contractual rights;

  • Any content or material you submit or make available through the Website.

Ask&Fix Ltd reserves the right to assume exclusive control over the defense of any claim for which indemnification is required. In such event, you agree to fully cooperate with our legal counsel and to cover all indemnifiable liabilities incurred.

12. Dispute Resolution and Binding Arbitration

12.1. Scope of Arbitration Agreement

This Section establishes a binding arbitration process for resolving disputes between you and Ask&Fix Ltd, its affiliates, and its representatives. It applies to any legal or equitable claim arising from or relating to:

  • These Terms or any prior agreement;

  • Your use of the Website or Services;

  • The relationship between you and Ask&Fix Ltd, regardless of legal theory (contract, tort, statute, misrepresentation, etc.);

  • Disputes existing prior to your acceptance of these Terms or arising after termination.

This arbitration clause does not apply to:

  • Claims that qualify for resolution in a small claims court;

  • Equitable relief claims related to the enforcement or protection of intellectual property rights.

If a dispute involves both arbitrable and non-arbitrable issues, the non-arbitrable issues will be stayed until resolution of the arbitrable ones.

12.2. Informal Dispute Resolution First

Before initiating arbitration, you agree to attempt to resolve the issue informally. Send a written summary of your concern, including your name and contact information, to support@asknfix.com. We will make reasonable efforts to resolve the dispute through direct negotiation. If no resolution is reached within sixty (60) days, either party may initiate formal arbitration.

12.3. Binding Arbitration Rules

If informal resolution fails, any dispute must be submitted to final and binding arbitration, as follows:

  • Non-U.S. residents: Arbitration will be administered by the London Court of International Arbitration (LCIA) under its rules.

  • U.S. residents: Arbitration will be conducted by JAMS, using:

    • Streamlined Arbitration Rules for disputes under $250,000;

    • Comprehensive Arbitration Rules for all others.

If neither LCIA nor JAMS is available, the parties will agree on a mutually acceptable alternative forum.

In case of a conflict between arbitration rules and these Terms, these Terms shall govern.

12.4. Arbitration Process and Procedures

Starting arbitration: You must follow the instructions provided by LCIA or JAMS.

Fees: Consumers initiating arbitration shall pay no more than $250 in filing fees. Ask&Fix Ltd will cover the remaining arbitration costs unless the claim is deemed frivolous. If Ask&Fix Ltd initiates arbitration, it covers all arbitration-related costs.

Attorneys’ fees: Each party bears its own legal fees unless otherwise provided by arbitration rules or applicable law.

Selection of arbitrator: The arbitrator must be neutral, and both parties will have an opportunity to participate in their selection.

Hearings: Conducted by videoconference or teleconference unless an in-person hearing is reasonably warranted. Consumers may request in-person hearings in their local area.

Discovery and confidentiality: Each party may request relevant, non-privileged information. Confidential information disclosed during arbitration must be sealed and used only for dispute resolution.

Legal communication with arbitrator: All communications must include both parties—no ex parte communication is permitted.

Governing law applied by arbitrator:

  • Non-U.S. residents: Laws of England and Wales.

  • U.S. residents: Delaware law, in line with the Federal Arbitration Act.

Award: The arbitrator shall issue a written decision explaining the outcome and reasoning. That decision shall be final and enforceable in any court of competent jurisdiction.

12.5. Class Action and Jury Trial Waiver

You and Ask&Fix Ltd agree that:

  • All disputes must be resolved individually;

  • Neither party may participate in or initiate a class action, class arbitration, or other collective proceedings;

  • The arbitrator shall not consolidate claims from more than one party;

  • You waive your right to a trial by jury and to participate in any representative actions.

This waiver is a material condition of your agreement to arbitration.

12.6. Exceptions: Intellectual Property and Small Claims

This arbitration agreement does not prevent either party from:

  • Filing intellectual property claims in a court with appropriate jurisdiction;

  • Bringing qualifying disputes in small claims court.

12.7. 30-Day Right to Opt Out

You may opt out of this Arbitration Agreement by sending written notice to support@asknfix.com within 30 days of:

  • Your first use of the Website; or

  • The effective date of these Terms (whichever is later).

Subject line: “ARBITRATION AND CLASS WAIVER OPT-OUT”
Include your full name and clear intent to opt out. If you opt out, both you and Ask&Fix Ltd will proceed under the standard legal jurisdiction as described in Section 13.

12.8. Severability

If any part of this Arbitration Agreement is deemed unenforceable:

  • That portion will be severed;

  • The remainder of the agreement will remain valid;

  • Class or representative claims may only proceed in court (not arbitration), and only if arbitration for such claims is deemed invalid.

12.9. Survival

This Arbitration Agreement will remain in effect even after the termination of your account or cessation of your use of the Website.

13. Modifications, Party Assignments, and Notifications

13.1. Amendments to the Terms

Ask&Fix Ltd reserves the right to update, modify, revise, or replace these Terms of Use (in whole or in part) at any time, with or without advance notice. Such modifications may be implemented by:

  • Posting an updated version of the Terms on the Website; or

  • Providing you with a direct notification via email or other electronic means.

Unless otherwise stated, the revised Terms will become effective immediately upon publication or transmission, whichever occurs first.

It is your responsibility to review the Terms periodically to stay informed of any updates. Continued use of the Website after changes have taken effect shall constitute your acceptance of the revised Terms. You may not modify these Terms unless such modifications are explicitly accepted in writing by Ask&Fix Ltd.

Any new features, tools, or services introduced to the Website shall be governed by the current version of these Terms.

The word “modification” in this section should be interpreted broadly to include any amendment, revision, deletion, or addition.

13.2. Assignment and Transfer of Rights

Ask&Fix Ltd may, at its sole discretion, assign, transfer, or delegate its rights and obligations under these Terms to another entity or third party without requiring your separate consent. Such transfers may occur through corporate restructuring, acquisition, merger, or other legal mechanisms.

In such cases, the updated party may be indicated directly in the Terms posted on the Website. Your continued use of the Website after such posting will constitute acknowledgment and acceptance of the new party to the agreement, unless otherwise stated.

You may not assign or transfer your rights or obligations under these Terms without prior written consent from Ask&Fix Ltd.

13.3. Method of Notifications

We may deliver legal notices, account information, service changes, or other important communications via:

  • Announcements on the Website;

  • Direct email to the address you provided during registration;

  • Other digital channels used within your account.

Email notifications shall be deemed delivered and effective upon sending, even if:

  • The message is automatically filtered into your spam or junk folder;

  • You fail to read the message for any reason;

  • The email client deprioritizes or redirects it.

To ensure proper delivery, you are encouraged to:

  • Add support@asknfix.com to your email contact list;

  • Mark messages from our domain as “safe” or “important”;

  • Regularly review your inbox and spam folder.

Failure to receive or review such notices will not exempt you from their effect.

14. Term and Survival of Agreement

These Terms of Use become effective once you first access or use the Website and remain in force for the entire duration of your account activity. The agreement will terminate automatically upon the closure of your account by you or by Ask&Fix Ltd, unless otherwise extended in writing.

However, certain provisions of this agreement shall survive termination, including but not limited to:

  • Section 3 (User Conduct),

  • Section 5 (Communication Rules),

  • Sections 7–12 (Account Termination, IP Rights, Warranties, Liability, Dispute Resolution),

  • Section 13 (Modifications and Notices).

Ask&Fix Ltd reserves the right to pursue any legal or equitable remedy available for violations of these Terms, including after termination, if such violations have caused or may cause harm to the Company, its Users, or third parties.

15. Electronic Signature Consent

By clicking on buttons such as “SUBMIT,” “I ACCEPT,” “I AGREE”, or similar confirmations displayed on the Website, you agree and acknowledge that your action constitutes a legally binding electronic signature. This signature carries the same force and effect as a handwritten signature on a paper contract.

You further agree that your use of electronic communications, signatures, records, and transactions satisfies any legal requirement that such actions be in writing, in accordance with applicable laws and regulations, including (but not limited to) the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) or similar electronic transaction laws in other jurisdictions.

You expressly waive any rights or requirements under laws that mandate original (non-electronic) signatures, paper records, or non-digital methods of communication or payment.

16. Miscellaneous Provisions

16.1. Governing Law and Legal Jurisdiction

Unless otherwise provided herein, this Agreement shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of laws principles.

Where arbitration is not applicable or enforceable, any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales. Both parties irrevocably submit to the personal jurisdiction of such courts and waive any objections based on venue, inconvenience of the forum, or lack of personal jurisdiction.

16.2. Entire Agreement and Severability

These Terms of Use, together with any linked or incorporated policies (such as the Privacy Policy), constitute the entire agreement between you and Ask&Fix Ltd regarding your use of the Website and Services.

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, the remainder of the Agreement shall remain in full force and effect.

16.3. No Waiver

No waiver by Ask&Fix Ltd of any term or condition set forth in this Agreement shall be deemed a further or continuing waiver of such term or any other term. Any failure to enforce any provision of this Agreement does not constitute a waiver of that or any other right.

16.4. Force Majeure

Ask&Fix Ltd shall not be liable for any delay or failure in performance caused by events or circumstances beyond its reasonable control. These may include (but are not limited to): acts of God, natural disasters, war, terrorism, government actions, civil unrest, power or internet outages, cyberattacks, or labor disruptions.

Performance will be suspended for the duration of such events, and resumed once the cause is resolved.

16.5. No Partnership or Employment Relationship

You agree that no joint venture, partnership, agency, fiduciary, or employment relationship exists between you and Ask&Fix Ltd as a result of this Agreement or your use of the Website. You may not represent otherwise under any circumstances.

16.6. Section Headings

Headings in these Terms are included solely for organizational convenience and shall not affect the legal interpretation or construction of any provision.
